Q. In the city I live in before leasing or renting property the landlord/owner suppose to have the property inspected prior to moving in. When that's not done they suppose to be fine or possible jail time. Who is respondsible when no action have been taken? How can I make sure he is held responsible for his neilgence and reckless of someone safety and health. Can I hold the city responsible for allowing him to continue leasing unsafe property? Who should I contact and How do I make sure he is held respondsible?

A. The tenant is responsible for protecting their own rights. The tenant should have filed complaints with the city building or housing inspector during the tenancy. If your tenant rights were violated, you can sue the landlord in small claims court for your damages. It may be difficult to prove after the tenancy though.

You can file a complaint with the city. What action the city takes is up to the city. If the city knowingly did not enforce it's building codes, I suppose you could sue the city for negligence. However, you can't hold the city responsible for something it was unaware of.

Q. I had to take out contents insurance as part of my agreement when I took on a rented property. I paid 5 months worth however, I missed the 6th month as I didnt re-new the policy because I moved out.
Now they want to take it from my deposit they have. Can they do this even though im not living there? The payment from me goes directly to the estage agent who pays it to the insurance company - it does not go directly to the insurance company from me.

Is it wise to buy rental property to make income when you yourself still rent an apartment?

Q. Me and my fiancée rent an apartment. We want to get into owning and renting property. Have found some good deals that we could buy then turn around and rent them out. (Not places we would want to live in for space reasons) Is this a good idea to do while we are still renting ourselves?

A. If you screw it up they can't come and take your house. If you are looking at it as a business then I don't see why not. May people spend thousands of dollars investing in something for a return over time. I guess it's no different than buying a lawn tractor and mowing lawns. It is beneficial to know a bit about home ownership before you rent a home to tenants. You aren't going to have the apartment manager to call if something is broken.

I am renting property from someone, is it against the law for them to place notices in my locked mailbox?

Q. I have been renting property and on several occasions my landlord has gone into my locked mailbox to place notices for me. I am aware that she is the property owner but she no longer receives mail there and because I am now renting the property I dont believe she has the right to use her key to go into my mailbox? I feel like it is an invasion of my property/privacy and could border on the lines of mail tampering. Any help would be greatly appreciated.

A. Totally illegal. Anything in a mailbox MUST have postage. Call the USPS in your area. She shouldn't even have a key.

In some cases they might provide vanilla legal advice.

An attorney would not be able to assist you with those items. He would consult with you, send you to what ever agency that would do the job. You would now have to pay the attorney as well as for the agency that would actually be doing or providing the services.
